The Attorneys’ Fees Spreadsheet synthesizes the fees and expenses data from Plaintiffs’ Motion for Attorneys’ Fees, Reimbursement of Expenses, and Service Awards for Class Representatives in all three cases (House/Carter/Hubbard). Class Counsel filed these motions on December 17, 2024.
Plaintiffs have asked for a percentage (contingency fee) of damages and revenue sharing (injunctive relief). This fee structure is much different and more lucrative than the “lodestar” calculations, which are based on hours actually worked.
The Spreadsheet compares the percentage formula to the lodestar formula to show the massive increase in fee payouts.
The actual value of the attorneys’ legal work is approximately $69 million. Based on percentages, they seek over $750 million.
Class Counsel conflated House and Carter fees and expenses. This disguises how little time and effort went into Carter. However, when Class Counsel filed their original settlement documents on July 26, 2204, they provided some disaggregated figures for Carter. Our estimate of the percentage increases from Carter’s lodestar to the 10% ($60 million) requested is based on the 7/26 filings.
